President Donald Trump and his sons, Donald Trump Jr. and Eric Trump, have posted their reactions after an appeals court overturned the massive civil fraud penalty against their family.
A five-judge panel of New York’s Appellate Division concluded that the $515 million judgment, originally set at $355 million plus interest, was “excessive” and unconstitutional under the Eighth Amendment.
“TOTAL VICTORY in the FAKE New York State Attorney General Letitia James Case! I greatly respect the fact that the Court had the Courage to throw out this unlawful and disgraceful Decision that was hurting Business all throughout New York State. Others were afraid to do business there. The amount, including Interest and Penalties, was over $550 Million Dollars. It was a Political Witch Hunt, in a business sense, the likes of which no one has ever seen before,” President Trump said on Truth Social.
He added that “it should have never been allowed to happen, and everyone knew it.”

New York Attorney General Letitia James, who filed the lawsuit against Trump and his children, said the court affirmed the “well-supported” finding of fraud. James said her office plans to appeal “to protect the rights and interests of New Yorkers.”

“While the injunctive relief ordered by the court is well crafted to curb defendants’ business culture, the court’s disgorgement order, which directs that defendants pay nearly half a billion dollars to the State of New York, is an excessive fine that violates the Eighth Amendment of the United States Constitution,” Judges Dianne T. Renwick and Peter H. Moulton wrote in an opinion.
The court’s five judges split on the merits of the lawsuit and Engoron’s finding of fraud. A majority decision was not reached. Instead, the ruling resulted from some judges endorsing parts of their colleagues’ findings while denouncing others.
The court took 11 months to release its ruling after hearing oral arguments last fall. Appeals are typically decided in a matter of weeks or a few months.
After a months-long trial, Trump said in January 2024 that he was “an innocent man.” The president and his lawyers have said his financial statements were not deceptive and that bankers and insurers independently evaluated the numbers.

The ruling allows for a possible appeal to the state’s highest court, the Court of Appeals. James indicated that she will seek an appeal.
Trump and his co-defendants can seek to extend the pause on any punishments taking effect, which were put on hold during the appeals process.
